Important Information:

Dulger Homes only uses customers personal information to complete their home from start to finish, in accordance to the privacy act. The house price provided includes the permit fee and quality assurance inspections registered building surveyor nominee by owners. Dulger Homes fixed pricing is based on standard floor plan only. Any additions from the options catalogue that increases the standard floor plans may incur a price adjustment over and above cost of option chosen.

Overlooking and Overshadowing:

Some lots may have issues with overshadowing or overlooking of your neighbour’s home or private open space. Dulger homes will conduct a feature survey and plans to confirm if this may be an issue for your individual lot. these issues are lot-specific, and the client acknowledges that no guarantee has been made to the suitability of the Land.

Energy Rating:

All Dulger homes standard plans comply with a 7-star energy rating, using the best solar orientation. If any changes to the standard plans are made that result in the 7-star rating not being achieved the cost of satisfying these criteria will be passed on to the client. This report will be made available to the client once completed.

Walls on Boundaries:

If the customer wishes to build to the boundary, Dulger Homes will assess the need to provide overhand bricklaying. The customer acknowledges that this assessment can not be until the frame stage has been completed. Any additional costs due to overhand bricklaying will be passed to the client by way of Post contract variation.

Engineer’s Approvals:

The customer/s agree to provide Dulger Homes with a copy of their compaction report within five business days of their Property’s Plan of subdivision which has been registered with the Land Title Office. Dulger Homes will provide the compaction report to the engineer for approval of the slab design. The owner(s) agree and acknowledge that Dulger Homes accepts no responsibility for its Engineers’ recommendations on the approval or rejection of the compaction report and the design of the slab as prepared by the engineer is final. If the engineer does not accept the owner(s) Compaction Report then additional charges may apply for any piers, screw piles and deepened edge beams as required.

Conditions on Site:

It is the customer’s responsibility to ensure that; All survey pegs are present on-site prior to the commencement of building works. Should there be missing pegs, the client will be liable for the cost of the re-establishment fees, which may be arranged by the builder. To provide to the builder a clean site (Grass cut, debris removed etc..) prior to commencement of building works. To ensure the availability of underground power to the site. Due to OH&S requirements, Dulger Homes reserves the right not to construct a dwelling where underground power is not available. For all knockdown and rebuild projects, the client is responsible to pay for relevant reestablishments of existing and new services. Such as telephone, electricity, gas, water, and internet. The customer is responsible to obtain a council permit to remove any existing trees affecting the building envelope and the client must remove offending trees prior to the commencement of building work.

Price Lock:

Dulger Homes agree to fix the base price of the house for 12 months from the date of the initial deposit and subject to your land settling within this period if; The signing of an HIA New Home Contract and payment of a 5% deposit of the contract value within a period of 90 days from the initial deposit The customer providing unconditional finance approval within the days stated in the HIA contract The customer provides proof of land ownership by way of a land contract signature and proof of an initial minimum 5% deposit on the land or proof of settlement. in the case of customers providing funds from personal accounts, Dulger homes reserve the right to ask clients to provide proof of finance/funds on an ongoing basis (weekly, fortnightly, or monthly). Or provide a trust account where funds for the next stage are deposited before work commences. If the customer is unable to fulfil the above requirements, Dulger Homes reserves the right to apply an increase of 2% on the base sales price every 90 days thereon. The customer agrees that the additional price increase can be charged by way of post-contract variation. If the land settlement is delayed more than 18 months from the initial deposit date, Dulger Homes reserves the right to reject the job and refund the 5% deposit to the client less out-of-pocket expenses. A $550 administration fee will apply to all client-initiated variations after the signing of the contract and colour selection. Price lock does not include any quoted additional items before the signing of the contract. This price lock applies to the base price only.

Non-Standard Changes:

Any non-standard requests are subject to approval by Dulger Homes. the client is aware that the display homes may have the option on display that may differ from the standard specification. (Home design specific) The client has been provided with a copy of the inclusions, upgrade options lists and promotional material specific to their selected home.

BAL Levels:

Bushfire attack level assessments are constantly being reviewed by the Department of Planning and Dulger Homes reserves the right to apply additional charges or credits based on the final assessment prior to obtaining a building permit.

Developer Approvals:

Should your home be subject to Developer Guidelines and Approval, your Dulger Homes sales consultant will make an assessment and attempt to include all requirements. The customer acknowledges and accepts that any additional charges will be payable by the client due to this process. The customer accepts and acknowledges that they have read and reasonably understand the developer’s guidelines.

Price is subject to change:

The builder reserves the right to increase the price of this quotation to recover any increase in G.S.T. or an increase in the cost to the builder in the construction of your home effective after the date of this quotation. This document is a sales quotation only. Items and pricing are to be confirmed once all relevant documentation has been received. Dulger Homes will price lock the base price for 12 months after the date of deposit, upgrade items will however be adjusted during the tender stage and finalized upon signing the contract.

 

Acceptance of Quote:

By signing the sales quotation, the client agrees and acknowledges all the terms and conditions contained in the quotation. Dulger Homes will prepare a tender based on the information provided by the client. This quotation is only valid for 14 days from the date created, at which point a new quote must be generated.

Power Input:

Some items within your new home may require a run-in of 3 phase cabling, when these items are identified, you will be advised. Common items include: refrigerated heating and cooling, Induction cooktops and photovoltaic solar panels.

Fixed Site Costs Conditions:

The client acknowledges the following; 1. Site costs have been calculated on available information, and should this vary from the final documents/conditions on-site, additional costs may be incurred. 2. fixed site costs are for up to 500mm of fall across the lot 385mm waffle pod slab, SL82 steel mesh, N-12 control bars, rock excavation/removal (up to 3m3) and deepened edge beams (up to 300mm deep for maximum 10LM) including up to 24 bored piers (up to 1m deep 450mm wide). 3. fixed site costs exclude; Screw piles, slabs greater than 385mm, retaining walls, additional drainage, rejection of the level 1 compaction report, core drilling or rock blasting or any requests from the developer, surveyor or engineer. 4. For titled lots, a soil test will confirm site conditions and site costs offered. 5. for untitled lots, the customer acknowledges that a soil test will be completed once land titles. 6. Dulger Homes takes every precaution to correctly price fixed site costs, however, if conditions outside of the builder’s control arise that change the assessed site conditions, additional charges may be incurred. 7. No credits will be applied if less bored piers or deepened edge beams are required.

Structural Changes:

Dulger Homes will complete engineering on your project, where possible, before signing your HIA contract. In some instances, this is not possible (such as untitled land). the customer acknowledges that any non-standard changes, including window sizing, room dimensions or moving/reorganising rooms, may incur additional costs for structural works. Additional costs may apply when a HIA contract is signed before the engineering is complete, this will be passed to the client as a post contract variation.

Façade:

Facade images are indicative only, The structure (rooflines, materials, balconies, etc.) is included in the cost, and windows will be of a standard size

Town Planning and Council Approvals:

All of Dulger Homes standard floor plans comply with the SLHC (small lot housing code) for all lots less than 300m2. Any increase to building/wall heights, due to ceiling height increase, or block engineering (fall greater than 300mm) may require further planning approvals. The customer acknowledges that the above approvals have NOT been factored into this quoted price, and no allowance has been made for these approvals in any way. If any additional charges are incurred, Dulger Homes Pty. Ltd. will pass these charges onto the customer by way of Post contract variations.

Intellectual property policy

Dulger Homes invests significant time, effort and money every year designing outstanding Australian homes. We regularly receive design awards from the housing industry for these homes. Accordingly, we take our intellectual property rights very seriously. But it is not only our investment that we are trying to protect. It is also the investment that our paying customers make when they choose to design and build a Dulger Homes home. We believe that design is important – it is valuable and it deserves to be protected. We will always protect our rights and that of our paying customers in ensuring that others don’t improperly use property that is not theirs.

As a matter of law, all plans, designs, illustrations, photos, images or other similar material produced by Dulger Homes, whether in printed form or represented in actual homes are owned by Dulger Homes. It is a breach of Metricon’s copyright for anyone to use these, whether in whole or in part, unless expressly authorised by Metricon. The most common way we authorise people to use our intellectual property is through signing a building contract with Metricon. In the event that we detect or are informed of any breach of Dulger Homes’ intellectual property rights, we will pursue legal avenues to protect Dulger Homes and its customers. We have enforced these rights on a number of occasions and the remedy awarded can be for damages to be paid and these sums can be substantial.
